Overview

AI Products May Contain Valuable Design Assets Worth Protecting

Distinctive visual designs, icons and user interfaces generated by AI, or inherently associated with AI technologies, can enhance user navigation and interaction while potentially qualifying for protection as industrial designs.

  1. 01

    Distinctive Visual Assets

Visual designs, icons and interfaces generated by AI or associated with AI technologies may constitute distinctive design assets with identifiable features and commercial value.

  2. 02

    Preserving Distinctive AI Features

To create a distinctive on-screen product experience, standard interface structures should retain recognizable AI-related visual features while allowing the overall layout to evolve and continuously enhance the user experience.

  3. 03

    International Filing Strategy

Before a product is launched or commercially deployed, an international filing strategy should be developed with careful consideration of target markets, commercial value and the applicable design protection regimes in each jurisdiction.

Jurisdictions

GUI protection rules vary by country.

Instead of burying country rules in paragraphs, present them as quick jurisdiction cards so users can compare filing requirements faster.

US

Two-dimensional computer-generated icons may be registrable when shown in a hardware configuration. Animated and dynamic GUIs may also be registrable.

China

GUI filings may proceed without a hardware configuration, with the product or hardware name indicated in the application title.

Australia

GUI protection may require hardware configuration. Standalone GUI designs may face registrability limits.

EU

GUIs may be protected under the Community Design framework, depending on the representation and filing scope.

Japan

GUI designs may be registrable without hardware configuration when the filing requirements are satisfied.

Locarno Classification

Place GUI filings under the right visual design class.

GUI-related designs generally fall under Locarno classification 14-04 for screen displays and icons. Final classification should be confirmed based on the actual filing materials.
