Compulsory Arbitration:Anyone registering a Hong Kong domain name must agree to abide by the Dispute Resolution Policy. This requires the registrant to accept potential dispute resolutions through a coercive (compulsory) arbitration procedure.
Note: The Hong Kong International Arbitration Center (HKIAC) is currently the only accredited service agency in Hong Kong authorized to conduct these compulsory public domain name arbitrations.
Under the policy, a domain registrant must face compulsory arbitration if a complainant files a dispute based on the following three justifications:
The registrant's domain name is either identical with, or highly likely to cause confusion with, the complainant's registered trademark or service mark within Hong Kong.
The current registrant has no legitimate right to use the Hong Kong domain name, or they should not possess the relevant legal interests to claim it.
Evidence shows that the registrant's ".HK" domain name was registered and is actively being used in bad faith (maliciously used) to exploit the complainant's brand.
