AI systems often rely on distinctive visual interfaces, icons, avatars and screen displays. These visual elements can support product recognition and may be suitable for industrial design protection.

Industrial design protects the appearance of a product rather than the underlying function. For AI products, this can include two-dimensional GUI elements or three-dimensional visual assets that show a distinctive product appearance.

Because requirements differ by country, the filing strategy should be checked before public launch, app release or commercial deployment.

Jurisdictions

GUI protection rules vary by country.

US

Two-dimensional computer-generated icons may be registrable when shown in a hardware configuration. Animated and dynamic GUIs may also be registrable.

China

GUI filings may proceed without a hardware configuration, with the product or hardware name indicated in the application title.

Australia

GUI protection may require hardware configuration. Standalone GUI designs may face registrability limits.

EU

GUIs may be protected under the Community Design framework, depending on the representation and filing scope.

Japan

GUI designs may be registrable without hardware configuration when the filing requirements are satisfied.

Locarno Classification

Place GUI filings under the right visual design class.

GUI-related designs generally fall under Locarno classification 14-04 for screen displays and icons. Final classification should be confirmed based on the actual filing materials.
